These Terms constitute a binding legal agreement between you (the “User”, “Customer”, or “Buyer”) and RarePokémonCards.shop. If you do not agree with any provision of these Terms, you must discontinue use of this Site immediately and refrain from placing any order.

Effective Date & Governing Version

Your continued use of the Site following the posting of changes constitutes your unconditional acceptance of those changes. It is your responsibility to review these Terms periodically.

1. Definitions

For the purposes of these Terms of Service, the following definitions shall apply:

“TCG”	Trading Card Game, specifically the Pokémon Trading Card Game and its associated secondary collectibles market

2. Online Store Eligibility

2a. Age Requirement

Access to and use of this Site, including the purchase of Products, is restricted to individuals who meet the following eligibility criteria:

2c. Geographic Eligibility

We do not accept orders from users located in countries subject to active trade sanctions, export restrictions, or OFAC-designated jurisdictions

3. Pricing & Market Volatility

3a. Price Changes and TCG Market Fluctuation

The Pokémon Trading Card Game secondary collectibles market is among the most volatile asset categories in the global hobby sector. Accordingly, the following pricing terms apply to all Products listed on this Site:

All prices displayed on rarepokemoncards.shop are denominated in United States Dollars (USD) unless otherwise stated and are subject to change at any time without prior notice
Price adjustments may be made in real time in response to market conditions, grading census updates, auction results, secondary market price movements, or changes in our acquisition costs
The price applicable to your Order is the price displayed at the time you complete checkout and receive your order confirmation email — not any price displayed prior to that point
Historical prices, previously displayed values, or prices shown in cached browser views do not constitute binding offers and carry no legal weight following a price change

3b. Pricing Errors & Typographical Mistakes

Despite our best efforts to maintain accurate listings, pricing errors may occasionally occur as a result of system faults, manual entry errors, or third-party data feed discrepancies. We expressly reserve the following rights in such circumstances:

RarePokémonCards.shop reserves the unconditional right to cancel any Order — prior to shipment — where the purchase price is the result of a clear typographical error, system glitch, data feed fault, or any price that is manifestly inconsistent with the fair market value of the Product at the time of listing. In such cases, a full refund of the amount paid will be issued to the original payment method. We are not obligated to fulfil any Order placed at an erroneous price, regardless of whether an order confirmation has been issued.

3c. Taxes, Duties & Currency

Prices displayed on the Site do not include applicable sales tax, VAT, import duties, customs fees, or other governmental levies, which remain the sole responsibility of the User
Where tax is applicable and calculable at checkout, it will be displayed as a separate line item before order completion
Currency conversion fees, where applicable, are the responsibility of the User’s bank or payment provider

4. Payment & Order Verification

4a. Accepted Payment Methods

RarePokémonCards.shop accepts payment via the methods displayed at checkout at the time of your Order. All payments are processed through encrypted, PCI DSS-compliant third-party payment gateways. By submitting payment information, you represent and warrant that:

You are the authorised holder of the payment instrument being used
The payment information you provide is accurate, complete, and current
You are legally authorised to make the purchase using the selected payment method

4b. Order Verification & Security Screening

All Orders placed through rarepokemoncards.shop are subject to a mandatory security and fraud screening process before acceptance. This process is conducted automatically by our payment gateway infrastructure and, where required, by our internal Vault Team.

We expressly reserve the right to refuse, hold, or cancel any Order where one or more of the following conditions are detected:

Chargeback history	The payment instrument or account has a documented history of unauthorised chargebacks against this or affiliated stores
Order anomalies	Unusually large order quantities, duplicate orders within a short timeframe, or other patterns inconsistent with genuine collector behaviour

Order holds and verification requests

Where an Order is flagged for review, we may contact you at the email address provided at checkout to request additional verification information before processing. Failure to respond within 48 hours may result in the Order being cancelled and the payment voided or refunded. We are not liable for any loss or inconvenience arising from an Order hold or cancellation made in good faith under these security provisions.

4c. Order Confirmation & Contract Formation

An Order confirmation email sent to your registered email address constitutes acknowledgement of receipt of your Order, not acceptance of a binding contract of sale. A binding contract between you and RarePokémonCards.shop is formed only at the point at which your Order has passed security screening, your payment has been successfully authorised, and your item has been assigned for fulfilment by our Vault Team. We reserve the right to decline any Order prior to that point without liability.

4d. Chargebacks & Payment Disputes

Filing a chargeback or payment dispute with your bank or card issuer without first exhausting our internal resolution process constitutes a material breach of these Terms and may result in:

Permanent suspension of your account and all associated accounts
Referral to our legal representatives for recovery of disputed amounts plus applicable costs
Reporting of the dispute to relevant fraud prevention databases

5. Product Listings & Authenticity

5a. Listing Accuracy

We make every reasonable effort to ensure that product descriptions, grading information, condition assessments, set details, and photography accurately represent each item listed for sale. However, we do not warrant that product descriptions are entirely free from error and reserve the right to correct any inaccuracy at any time.

5b. Grading & Condition Representations

For professionally graded slabs (PSA, BGS, CGC), the grade and certification number displayed in the listing are derived directly from the grading company’s records and the physical label on the slab. We do not independently assign numerical grades to encapsulated cards.
For raw ungraded singles, condition descriptions are the assessed opinion of our Vault Team based on standardised TCG condition criteria. These represent our good-faith assessment and do not constitute a guarantee of any third-party grading outcome.
Grading outcomes from third-party grading companies, should you choose to submit a purchased item for independent grading after receipt, are entirely at the discretion of that grading company and do not constitute grounds for a return, refund, or dispute against RarePokémonCards.shop.

5c. Product Availability

All Products are listed subject to availability. In the rare event that a Product becomes unavailable after your Order has been confirmed — due to simultaneous purchase, inventory error, or physical damage discovered during fulfilment — we will notify you promptly and issue a full refund to your original payment method. We are not liable for any further loss arising from such unavailability.

6. Intellectual Property

6a. Ownership of Site Content

All content published on rarepokemoncards.shop, including but not limited to the following, is the exclusive intellectual property of RarePokémonCards.shop and is protected by applicable copyright, trademark, trade dress, and intellectual property laws:

Site name, logo, wordmark, and brand identity elements
Custom site layout, design architecture, and user interface elements
All original written copy, product descriptions, policy documents, and editorial content
Custom product photography, lighting setups, and archival imagery produced by or for our store
All graphics, iconography, colour schemes, and visual design elements
Marketing materials, email templates, and promotional content

6b. Restrictions on Use

You are expressly prohibited from:

Reproducing, copying, distributing, or publishing any part of this Site’s content without our prior written consent
Using our brand name, logo, or any confusingly similar mark in connection with any competing or unrelated commercial activity

6c. Third-Party Intellectual Property

All Pokémon-related trademarks, character names, card artwork, set names, and associated intellectual property are the property of The Pokémon Company International, Inc., Nintendo Co., Ltd., and Creatures Inc. RarePokémonCards.shop operates as an independent secondary market retailer and is not affiliated with, endorsed by, or officially associated with any of these entities.

7. Shipping, Delivery & Carrier Liability

7a. Dispatch & Transit

All shipping, delivery, and packing terms are governed in full by our Shipping Policy, available at rarepokemoncards.shop/shipping-policy, which is incorporated into these Terms of Service by reference.

7b. Risk of Loss

Risk of loss and title for all Products pass to the Buyer upon handover of the package to the designated shipping carrier. Once a shipment has been collected by the carrier and a tracking number has been assigned, RarePokémonCards.shop’s direct custodial responsibility for the physical item ends, subject to our insurance and claims assistance obligations set out in our Shipping Policy.

7c. Carrier Delays & Force Majeure

We are not liable for any delivery delays, losses, or service failures attributable to the shipping carrier, including but not limited to delays caused by customs clearance, adverse weather, industrial action, natural disaster, pandemic, civil unrest, or any event beyond our reasonable control. Estimated delivery timeframes are provided by carriers as guidance only and do not constitute a contractual guarantee of delivery by a specific date.

8. Returns & Refunds

All return and refund requests are governed exclusively by our Refund & Return Policy, available at rarepokemoncards.shop/refund-return-policy, which is incorporated into these Terms of Service by reference and forms part of this binding agreement. By placing an Order, you confirm that you have read and accepted the terms of that policy in full.

9. Limitation of Liability

9a. General Limitation

To the fullest extent permitted by applicable law, RarePokémonCards.shop, its owners, directors, employees, agents, suppliers, and service providers shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages of any kind arising from or in connection with your use of this Site or the purchase of Products
Loss of profits, revenue, data, business opportunity, or goodwill, whether arising in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such damages
Damages arising from transit delays, carrier mishandling, customs seizure, or force majeure events caused by third-party shipping carriers engaged in good faith to fulfil your Order
Fluctuations in the market value of purchased Products following the completion of a sale, including price movements driven by grading census changes, market corrections, or broader TCG market conditions
Technical failures, service interruptions, or data loss resulting from circumstances beyond our reasonable control, including hosting outages, cyberattacks, or third-party platform failures

9b. Cap on Liability

Where liability cannot be fully excluded by law, our total aggregate liability to you in respect of any claim arising from or related to these Terms or your use of this Site shall not exceed the total purchase price paid by you for the specific Order to which the claim relates.

9c. Consumer Statutory Rights Preserved

Nothing in this Limitation of Liability clause is intended to exclude or restrict any statutory rights you hold as a consumer under the applicable law of your jurisdiction that cannot lawfully be excluded by contract. Where such rights exist, they remain fully in force.

10. Indemnification

You agree to indemnify, defend, and hold harmless RarePokémonCards.shop and its owners, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

Your breach of any provision of these Terms of Service
Your violation of any applicable law or regulation
Your infringement of any third-party intellectual property, privacy, or other proprietary right
Any fraudulent, negligent, or wilfully harmful act or omission on your part in connection with your use of this Site

11. Disclaimer of Warranties

This Site and all Products and services offered through it are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

The Site will be uninterrupted, error-free, or free from viruses or other harmful components
The results of using the Site or purchasing Products will meet your specific expectations or requirements
Any errors or defects in the Site will be corrected within any particular timeframe

12. Governing Law & Jurisdiction

12a. Governing Law

12b. Dispute Resolution

If a resolution cannot be reached within 30 days of written notice of the dispute, either party may pursue the matter through the appropriate legal channels available in the governing jurisdiction.

12c. Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any claim or dispute against RarePokémonCards.shop must be brought on an individual basis only, and you expressly waive any right to bring or participate in any class action, collective proceeding, or representative action arising from or related to these Terms or your use of this Site.

13. Severability & Entire Agreement

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.

These Terms of Service, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and RarePokémonCards.shop with respect to your use of the Site and supersede all prior agreements, representations, warranties, and understandings of any kind, whether written or oral.
